Complaint timeframes by sector

There is no single eight-week rule

One of the easiest mistakes is to assume every complaint uses the same response period. It does not. The relevant clock depends on the sector, the organisation, the type of complaint and sometimes the specific product involved. A payment-services complaint can use a shorter FCA timetable than an ordinary financial complaint. Telecoms and energy have different ADR waiting periods. Council complaints can change completely when the subject is children’s social care, adult social care or a statutory appeal.

Keep separate dates for: the original complaint, internal escalation, final response, external referral, decision review and court limitation. Continued correspondence after a final response does not necessarily extend the external deadline.

FOIMost public authorities have 20 working days for the initial FOI response. Internal review is normally expected within 20 working days, up to 40 in exceptional cases.ICO expects the internal-review route first in most cases and asks complaints to be made promptly, generally within 6 weeks of the final response or last meaningful contact.

Complaint deadlines and legal limitation are different

An ombudsman referral deadline is not the same as the time limit for bringing a court claim. A company continuing to discuss your complaint does not automatically extend either one. If court action is a realistic option, identify the applicable limitation period separately and obtain legal advice where necessary.

Record the date that actually starts the clock

Do not rely on the date you first phoned customer service if the scheme counts the date of a formal complaint. Keep the complaint submission, acknowledgement and final response. For council stages, keep the date you requested Stage 2. For ombudsman decisions, keep the issue date and the date by which acceptance, rejection or challenge must be made.
